The REEECYC'LAB tool is operated by ESR, a company incorporated under French laws (société par actions simplifiée) with variable capital of €241,000, whose registered head-office address is 34-40, rue Henri Regnault 92400 Courbevoie, registered with the Nanterre Registry of Trade and Companies under number 830 339 362.
ESR developed the REEECYC'LAB tool for the evaluation of the recyclability of electrical and electronic equipment placed on the French market by producers.
GTU: The general terms governing the terms of access and use of the site reeecyclab.eco-systemes.fr and the REEECYC'LAB tool.
User: Any producer having signed up, directly or via an agent, to ESR.
REEECYC’LAB: The tool for assessing the recyclability of electrical and electronic equipment.
Tool: It consists of the following components: database developed by ESR, source code ensuring the functioning of the application, graphic design of the application and of its logo.
Site: The site accessible via the following address: reeecyclab.eco-systemes.fr.
2.1. The REEECYC'LAB tool is an educational tool to understand, assess and improve the recyclability of electrical and electronic equipment. It makes it possible to establish a specific diagnosis of the product being studied, as part of a global ecodesign approach.
2.2 REEECYC'LAB allows testing of different design alternatives and identification of areas for improvement.
2.3 REEECYC'LAB allows each User to save, in their personal account, the completed or ongoing evaluations.
2.4 REEECYC'LAB allows each User to save, in their personal account, part templates that can be re-used in different product evaluations.
2.5 REEECYC'LAB allows each User to print an evaluation report, including the results of an evaluation as well as a summary of the data entered.
3.1. The use of the REEECYC'LAB tool is conditioned by prior acceptance of the GTU. By checking the checkbox provided on the Site's homepage, the User acknowledges that he has read the GTU and expressly and unrestrictedly accepted them.
3.2. ESR reserves the right to modify the GTU at any time, without prior notice. Any modification of the GTU takes effect from the date of its publication online and is immediately enforceable against the User. The User is therefore invited to regularly check the GTU to keep up to date with their changes.
3.3. If the User does not accept the new GTU published online, the User must notify ESR of this fact in writing and cease to use the Site from this notification. From receipt of notification by ESR, the User's access codes shall be disabled.
3.4. The User commits to comply with these GTU. In case of breach of the GTU, ESR can deny the User access to the Site, or even file a legal action in order to engage the User’s liability.
4.1. Access to the REEECYC'LAB tool is free of charge (except for the provision of internet access of which the cost is billed directly by operators). The tool is provided on a dedicated Site: reeecyclab.eco-systemes.fr.
4.2. Access to REEECYC'LAB is reserved for Users only. Upon first login in the Tool, the User fills in a registration form and enters the information required for his registration (company's name, ESR membership number, surname, first name and e-mail address, password). After verification of the User's membership, his login data are validated and activated, enabling the User to access the Tool and its functionalities.
4.3. The user name and password enabling access to the Tool are personal and confidential. The User is liable for safekeeping his login data and using them in accordance with the GTU. The User must take necessary precautions to prevent any fraudulent use of his login data. The User shall be held liable for any usurpation of his login data and the resulting consequences for him and for ESR.
4.4 If a User loses his membership, the User’s right to access the Site and the Tool is withdrawn.
5.1. The REEECYC'LAB tool is available 24/7. ESR takes all necessary measures to ensure the accessibility and proper functioning of the Tool. However, ESR reserves the right to suspend, interrupt or limit access to the REEECYC'LAB tool, without prior notice. In particular ESR can at any time suspend access to the Tool to ensure its maintenance or to update the Tool or the Site. The User cannot make any claims on this basis.
5.2. ESR cannot be held liable in case of default, failure, difficulty or interruption of functioning, preventing access to the Tool or to one of its functionalities. ESR shall do its best efforts to restore REEECYC'LAB within a reasonable time.
5.3. At any time, ESR might have to upgrade its Site by making improvements and/or modifications to REEECYC'LAB, particularly in order to comply with the current state of the art and standards. These updates can require the suspension of the Site. The User cannot make any claims on this basis. The User is then kept informed of the reopening date of the Site.
6.1. The REEECYC'LAB tool and all its components are creations of ESR. Accordingly, ESR is the exclusive owner of REEECYC'LAB and holds all the intellectual property rights and related rights of use.
6.2. As such, the general structure of the REEECYC'LAB tool, the software programme, the content and structure of the database, and all the Tool's components (calculation rules, statistical data, methodologies, indicators, texts, graphics, designs, videos, logos, etc.) are protected by intellectual property rights.
6.3. Access to REEECYC'LAB does not grant any right on the Tool other than that for the User to be able to benefit from its functionalities in accordance with these GTU.
6.4. Any reproduction, representation or transmission, in full or in part, of the content of this Tool and of its database, on any medium and via any process whatsoever, and in general any unauthorised use or use non-compliant with the GTU is prohibited.
6.5. Breach of these provisions may lead to filing any appropriate legal action, particularly a counterfeit action. Furthermore, ESR reserves the right to suspend or prohibit access to the Site for any User who breaches these provisions.
7.1. ESR grants the User, free of charge and on a personal basis, the non-assignable and non-exclusive right to use, for its own needs, the software and the database included in REEECYC'LAB within the limits of these GTU.
7.2. The rights granted cannot be assigned, contributed or transferred to a third party (a subsidiary company of the User is considered as a third party), in any manner whatsoever. The rights of use are not assignable, even in case of the sale of the business, lease management, merger or any other operation according to which the User's rights would be transferred to a third party.
7.3. The license to use is granted for internal use by the User, the Tool’s purpose being to help the User understand, assess and improve the recyclability of the electrical and electronic equipment that he places on the market.
7.4. The User commits not to modify, adapt, or reproduce the REEECYC'LAB tool and its database, and in general to refrain from any use contrary to these GTU and to the law. More specifically, the User commits not to extract and reuse data from REEECYC'LAB, except for the cases restrictively specified in article 8 of the GTU.
7.5. The User ensures compliance with these general terms by its staff with access to REEECYC'LAB.
8.1. The User is exclusively liable for its use of REEECYC'LAB. He is solely liable for the data he enters into the Tool. An entry error by the User can modify, or even distort the evaluation provided by the Tool. By entering the precise characteristics of his products, the User can create his own part templates and assess his own products. The User is solely and fully liable for the resulting evaluations and their internal use.
8.2. The part templates created as well as the evaluations can be stored in the User's personal account. The User is the sole manager of its personal account.
8.3. It is recommended for the User to regularly backup the data entered into REEECYC'LAB and particularly the evaluations included in the User’s personal account. Accordingly, ESR authorises the User to make extractions, in PDF format, of the product evaluations carried out. No other extraction is authorised by ESR.
8.4. ESR provides the User with data on the average composition of certain components (henceforth referred to as "pre-filled data"). These data are based on ESR’s expertise and knowledge. These data are only indicative and are only intended to help the User. In no case should these pre-filled data be considered as reference values. ESR disclaims all liability in case of use of a product's recyclability rate evaluation that is based on pre-filled data.
8.5. The evaluations must be used exclusively internally. Any public use of the evaluations is contrary to these GTU and ESR cannot in any case be held liable as a result. If in spite of ESR’s recommendations, the User makes public use of the evaluations, he accepts full liability for the resulting consequences, without it being possible to file a legal action against ESR on this basis, and without appeal against the latter. Likewise, the User is liable for any public use of an evaluation of a product that the User has not placed on the market.
8.6 The User uses the evaluations on its own initiative and is exclusively liable for such use. The evaluations are carried out based on the data entered by the User in the online forms. ESR does not carry out any review of the truthfulness or accuracy of the data entered by the User and the evaluations obtained. The User is solely liable for any interpretation of the evaluations.
9.1. ESR provides the User with a tool matching the description featured on the Site's homepage, under the terms and within the limits of the GTU.
9.2. ESR commits to take all necessary measures in order to ensure the confidentiality, security and sustainability of the data entered by the User in REEECYC'LAB. ESR accordingly commits not to disclose to third parties or reproduce this data.
9.3. ESR guarantees that each User has a personal account in which they can store the data that they have entered as well as the evaluations that they have carried out. All the personal accounts are independent from each other; there is no link between them, which ensures the total confidentiality of each User’s data.
9.4. In spite of all the care taken in developing the REEECYC'LAB tool, the evaluations obtained by the User include a margin of uncertainty, connected in particular to any technical inaccuracies or typographical errors, the quality of the data entered by the User, as well as the state of scientific and technical knowledge. Accordingly, the evaluations obtained are for information and indicative purposes only and ESR cannot be held liable for them, in any manner whatsoever. ESR is bound by a standard duty of due care regarding the information provided to Users on its Site.
9.5. ESR cannot in any case be held liable for any damage of any kind whatsoever resulting from interpretation or use of the evaluations obtained. The User is solely liable for the use it makes of the evaluation results, and any resulting consequences, without possibility to file an action against ESR on this basis.
9.6. ESR cannot be held liable for:
- use by the User not complying with the GTU;
- alteration and/or loss of data during transfer (extractions mentioned in article 8 of the present) by means of telecommunication;
- any interruption of the Tool or disruption of its functioning, either due to ESR or to the telecommunications operator;
- direct and/or indirect, material and/or non-material, foreseeable or unforeseeable damage (particularly including loss of brand image, loss of profits, operating losses, losses of sales, shortfalls in earnings, loss of customers) resulting from the use or total or partial impossibility of using the Tool;
- any damage potentially suffered during a visit of the Site, by the User's computer system and particularly, the User’s computers, software, network hardware and any other equipment used to access or use the Tool;
- the reliability of data transmission, access time and in general the quality of the User's internet connection;
- cases of force majeure events, as defined by case law.
10.1. It is reiterated that the User is solely liable for his use of REEECYC'LAB, in accordance with the provisions of these GTU and particularly article 8 thereof.
10.2. In case of use in breach of the GTU or of the law, ESR can immediately suspend the User's access to the Site and file, if applicable, any legal action against him.
10.3. The User is solely liable for the compatibility of his hardware, his information system and internet network to the Tool. The User’s internet connection hardware is under his full liability. The User must take all appropriate measures to protect his hardware and own data, particularly against viral attacks over the internet or attempted security breaches on his system.
11.1. The User is informed that his registration on the Site results, for ESR, in the collection and automated processing of personal data concerning him, the use of which is governed by the provisions of French law no. 78-17 of January 6 1978 relating to Data Protection and by the EU General Data Protection Regulation 2016/679 of April 27 2016. These personal data are the User’s first name, last name and email address. The personal data are hosted in France and in the European Union.
11.2. These data are kept and used only for the sole purposes of identifying the User and securing access to the Tool. They are kept during the entire period necessary for the purposes for which they are collected and processed.
11.3. The User declares that he accepts the processing of his data by accepting these GTU and by using the Tool. The User has a right to access, correct and delete the personal data concerning him as well as a right to object to the processing of information concerning him, by sending a letter to the following address: ESR, 34-40, rue Henri Regnault 92400 Courbevoie.
11.4. ESR does its best efforts to secure the Users' personal data in accordance with current standards and practices.

13.1. ESR is a government-approved eco-organization. In case of withdrawal of its government approval, ESR shall be required to permanently close its Site.
13.2. ESR can also decide to close the Site for any other reason and particularly in case of inadequacy or obsolescence of the REEECYC'LAB tool.
13.3. Whenever possible, any closure shall be notified with sufficient prior notice in order to enable the User to make the necessary extractions under the terms provided for in article 8 of the GTU. In case of emergency, ESR reserves the right not to give this prior notice.
13.4. Any permanent closure of the Site results in the automatic and immediate termination of the license to use mentioned in article 7 of these GTU.
14.1. These GTU are governed by French law. Only the French-language version of the GTU has probative force between ESR and Users and can be used as evidence in court.
14.2. Any dispute relating to the use of the REEECYC'LAB tool and the application of the GTU shall be exclusively referred to the Commercial Court in Nanterre.
