The REEECYC’LAB tool is operated by ecosystem, a simplified joint-stock company with variable capital of 240,000 Euros, having its registered office at 34-40 Rue Henri Regnault, 92400 COURBEVOIE, registered in NANTERRE Trade and Companies Register as number 830 339 362.
ecosystem has developed the REEECYC’LAB tool, enabling the recyclability of electrical and electronic equipment marketed in France by the producers to be assessed.
The present General Terms of Use govern use of REEECYC’LAB.
Use of REEECYC’LAB implies compliance with the present General Terms of Use.
CGU: The general terms governing access to and use of the reeecyclab.ecosystem.eco site and the REEECYC’LAB tool.
User: Any producer having joined ecosystem, directly or through a representative.
REEECYC’LAB: The tool designed for the purpose of assessing the recyclability of electrical and electronic equipment.
Tool: It comprises the following elements: a database developed by ecosystem, the source code designed to operate the application, the graphical design of the application and its logo.
Site: The site accessible at the following address: reeecyclab.ecosystem.eco.
2.1 The REEECYC’LAB tool is an educational tool to understand, assess and improve the recyclability of electrical and electronic equipment. It enables a diagnosis specific to the analysed product to be made, as part of a global eco-design strategy.
2.2 REEECYC’LAB lets various design alternatives be tested, and areas for improvement be identified.
2.3 REEECYC’LAB lets each User save completed or pending assessments in its personal space.
2.4 REEECYC’LAB lets each User save, in its personal space, part models which can be re-used in different product assessments.
2.5 REEECYC’LAB lets each User publish an assessment report, including the results of an assessment and a summary of the entered data.
3.1 Use of the REEECYC’LAB tool is conditional on prior acceptance of the CGU. By checking the box shown on the Site's homepage the User acknowledges that it has examined the CGU and that it accepts them expressly, without any restriction.
3.2 ecosystem reserves the right to amend the CGU at any time, without prior notification. Any amendment of the CGU shall come into force on the date on which it is online, and shall immediately be binding on the User. The User is therefore invited to examine the CGU regularly to keep itself informed of any changes to them.
3.3 If the User does not accept the new online CGU, it must inform ecosystem thereof in writing, and cease to use the site from the time of this notification. On receipt of the notification by ecosystem, the User's access codes shall be deactivated.
3.4 The User undertakes to comply with the present CGU. In the event of a breach of the CGU, ecosystem may prohibit the User from accessing the Site, or go to law against it to have it held liable.
4.1 Access to the REEECYC’LAB tool is free of charge (excluding provision of Internet access, the cost of which is billed directly by the operators to the User). The tool is made available on a dedicated Site, reeecyclab.ecosystem.eco.
4.2 Access to REEECYC’LAB is reserved solely for the Users. When it logs into the Tool for the first time the User must complete a registration form, and enter the information required for its registration (name of the company, ecosystem member number, surname, first name and email address of the contact, and password). After a check is made that the User is indeed a member, its identifiers are validated and activated, enabling it to log into the Tool and access its functions.
4.3 The identifiers enabling it to log into the Tool are personal and confidential. The User is liable for keeping its identifiers, and for using them in compliance with the CGU. It is its responsibility to take the necessary precautions to prevent any fraudulent use of its identifiers. The User shall be held liable for any misappropriation of its identifiers and any consequences arising therefrom for it and for ecosystem.
4.4 A User which ceases to be a member shall have its right of access to the Site and to the Tool withdrawn.
4.5 After one year without activity the User shall receive an email informing it that its account is being deactivated. Any new activity on the account shall lead to it being reactivated. After one more year without activity the account shall be deleted.
5.1 The REEECYC’LAB tool is available 24 hours a day, 7 days a week. ecosystem takes all measures to ensure accessibility and satisfactory operation of the Tool. However, ecosystem reserves the right to suspend, interrupt or restrict access to the REEECYC’LAB tool, without prior notice. ecosystem can, in particular, suspend access to the Tool at any time in order to undertake maintenance of it, or to apply updates of the Tool or of the Site. The User shall not be able to make any claim on this basis.
5.2 ecosystem cannot be held liable in the event of failure, malfunction, difficulty or interrupted operation, preventing access to the Tool or to one of its functions. ecosystem shall strive to the best of its abilities to bring REEECYC’LAB back into service with a reasonable period.
5.3 ecosystem may upgrade its Site at any time, by making improvements and/or modifications to REEECYC’LAB, in particular in order to align itself with current scientific standards and the benchmarks in force. These updates may require suspension of the Site. The User shall not be able to make any claim on this basis. In this case the User shall be informed of the date on which the Site is to reopen.
6.1 The REEECYC’LAB tool and all elements constituting it are creations of ecosystem. This being so, ecosystem is the exclusive owner of REEECYC’LAB and holds all the intellectual property rights and rights of use relating to it.
6.2 The general structure of the REEECYC’LAB tool, the application, the content and the structure of the database, and all elements comprising the Tool (computation rules, statistical data, methodologies, indicators, texts, artwork, illustrations, videos, logos, etc.) are protected by the intellectual property rights.
6.3 The login to REEECYC’LAB grants no right over the Tool other than the User's right to be able to use its functions in compliance with the present CGU.
6.4 All reproductions, representations or distributions, in whole or in part, of the content of this Tool and of its database, on any medium or using any process whatsoever, and, generally, any unauthorised use or use not in accordance with the CGU, are prohibited.
6.5 A breach of these provisions may be followed by any appropriate action in law, and in particular an action for infringement of intellectual property. ecosystem also reserves the right to suspend or prohibit access to the Site to any User which infringes the present provisions.
7.1 ecosystem concède à l’Utilisateur à titre gratuit et personnel, le droit non cessible et non exclusif d’utiliser, pour ses propres besoins, le logiciel et la base de données inclus dans REEECYC’LAB dans la limite du respect des présentes CGU.
7.2 Les droits concédés ne peuvent être cédés, apportés ou transférés à un tiers (une société filiale de l’Utilisateur est considérée comme un tiers), de quelque manière que ce soit. Les droits d’utilisation ne sont pas cessibles, même en cas de cession du fonds, de location-gérance, de fusion ou de toute autre opération au terme de laquelle les droits de l’Utilisateur seraient transférés à un tiers.
7.3 La licence d’utilisation est consentie pour un usage interne à l’Utilisateur, l’objectif de l’Outil étant d’aider l’Utilisateur à comprendre, évaluer et améliorer la recyclabilité des équipements électriques et électroniques qu’il met sur le marché.
7.4 L’Utilisateur s’interdit de modifier, d’adapter, de reproduire l’outil REEECYC’LAB et sa base de données, et d’une manière générale toute utilisation contraire aux présentes CGU et à la loi. Plus particulièrement, l’Utilisateur s’interdit d’extraire et de réutiliser les données issues de REEECYC’LAB, sauf cas limitativement prévu à l’article 8 des CGU.
7.5 L’Utilisateur se porte fort du respect des présentes conditions générales par ses personnels ayant accès à REEECYC’LAB.
8.1 The User uses REEECYC’LAB under its exclusive liability. It is solely liable for the data which it enters in the Tool. An entry error by the User can modify or distort the assessment returned by the Tool. By entering the precise characteristics of its products, the User can create its own part models and assess its own products. The resulting assessments and their internal use are the User's sole and exclusive liability.
8.2 The part models created and the assessments can be stored in the User's personal space. The User is the sole manager of its personal space.
8.3 The User is recommended to make regular backups of the data entered into REEECYC’LAB, and in particular of the assessments present in its personal space. In this connection, ecosystem authorises the User to make, in PDF format, extracts from the product assessments made. No other extraction is authorised by ecosystem.
8.4 ecosystem makes data available to the User relating to the average composition of certain components (hereinafter "pre-completed data"). This data is derived from ecosystem's expertise and knowledge. This data is provided on an indicative basis, and its sole purpose is to assist the User. This pre-completed data must under no circumstances be considered to be reference values. ecosystem declines all liability if an assessment of a product's rate of recyclability is used which is based on pre-completed data.
8.5 The assessments must be used exclusively internally. Any public use of the assessments is contrary to the present CGU, and ecosystem can under no circumstances be held liable for such. If, despite ecosystem's recommendations, the User makes public use of the assessments, it shall assume liability for any consequences which may arise therefrom, and ecosystem would not be able to be held liable therefor, and there would be no possibility of legal recourse against it. In the same way, the User shall be held liable for any public use of an assessment of a product which it has not marketed.
8.6 The assessments shall be used by the User on its own initiative and under its exclusive liability. They are made on the basis of the information entered by the User in the online forms. ecosystem makes no checks concerning the truthfulness or accuracy of the information entered by the User or concerning the assessments obtained. All interpretations of the assessments are the User's sole liability.
9.1 ecosystem makes available to the User a tool matching the description given on the Site's homepage, on the terms and within the limits of the CGU.
9.2 ecosystem undertakes to use all means to ensure the confidentiality, security and permanence of the data entered by the User in REEECYC’LAB. ecosystem thus undertakes not to disclose this data to third parties or to reproduce it.
9.3 ecosystem guarantees that each User shall have a personal space in which it can store the data which it has entered and the assessments which it has made. All personal spaces are independent from one another; there is no gateway between them, which guarantees for each User complete confidentiality of its data.
9.4 Despite all the care taken in producing the REEECYC’LAB tool, the assessments obtained by the User involve a degree of uncertainty, relating in particular to possible technical inaccuracies or typographical errors, to the quality of the data entered by the User, and to the state of scientific and technical knowledge. Consequently, the assessments obtained have only an indicative and informative value, and ecosystem cannot be held liable for them in any manner whatsoever. ecosystem is bound by a simple undertaking of due care concerning the information made available to the Users on its Site.
9.5 ecosystem can under no circumstances be held liable for any damage of any kind whatsoever resulting from the interpretation or use of the assessments obtained. The User is solely liable for the use made by it of the result of the assessment, and of any consequences which may result therefrom, and ecosystem cannot be held liable therefor.
9.6 ecosystem cannot be held liable:
- for any use by the User which is not compliant with the CGU;
- for an impairment and/or loss of the data during the transfer (extractions referred to in article 8 hereof) by a telecommunication means;
- for any interruption of the Tool or disturbance of its operation, due either to ecosystem or to the telecommunications operator;
- for direct and/or indirect, tangible and/or intangible, foreseeable or unforeseeable damage (such as, in particular, loss of brand image, loss of profits, operating loss, commercial losses, loss of earnings, loss of clientele) arising from the use or from a total or partial impossibility of using the Tool;
- for any damage suffered during a visit to the Site, by the User's IT system, its computers, applications, network equipment or any other equipment used to access or use the Tool;
- for reliability of the transmission of the data, for the access time and, generally, for the quality of the User's Internet connection;
- in the case of events of force majeure, as defined by article 1218 of the Civil Code and case law.
10.1 It should be noted that the User uses REEECYC’LAB under its sole liability, in compliance with the provisions of the present CGU and in particular of its article 8.
10.2 In the event of any use which is not compliant with the CGU or with law, ecosystem may immediately suspend the User's access to the Site and, if applicable, bring any legal action against it.
10.3 The User is solely liable for the compatibility of its equipment, its IT system and its Internet network with the Tool. The User's Internet connection equipment is its sole liability. The User must take all appropriate measures to protect its equipment and its own data, in particular from viral Internet attacks, or attempted intrusions into its system.
11.1 The User is informed that its registration on the Site leads, for ecosystem, to collection or automated processing of personal data concerning it, use of which is subject to the provisions of law no. 78-17 of 6 January 1978 amended relative to Computing, Files and Freedom, and of European Regulation 2016/679 concerning data protection (GDPR) of 27 April 2016. This personal data is the User's first name, surname and email address, and login data. It is stipulated hereby that this personal data is hosted in France or in the European Union.
11.2 This data is kept and used for the sole purpose of identifying the User and of making access to the Tool secure. It is kept for the term required for the purposes for which it is collected and processed.
11.3 The User declares that it accepts to have its personal data processed by accepting the present CGU and by using the Tool. It has a right to view, to correct and to delete personal data concerning it, and a right to object to the processing of information concerning it, by sending a postal letter to the following address: ecosystem, 34-40 Rue Henri Regnault, 92068 PARIS LA DEFENSE CEDEX. If its personal data is deleted the User shall be prohibited from logging into its User Space(s).
11.4 ecosystem strives to the best of its abilities to keep the Users' personal data secure, in accordance with the standards and practices in force.
12.1 Definitions
Cookie: A cookie is a small text file which can be saved in the hard disk of your terminal when you visit a site or a Web application. It enables its issuer to identify the terminal in which it is saved, and to collect data concerning your Internet browsing. Cookies are managed by the Internet browser.
Terminal: refers to the hardware equipment which you use to view a website or to cause a website, an application or advertising content to be displayed.
Browsing information: This information can concern the IP address of the connected terminal, the time, the date and the place of connection, the Internet address of the visited site, and the type and version of the operating system used by the terminal (e.g.: Windows, MacOs, Linux, etc.), the type and version of the browser application (e.g.: Google Chrome, Firefox, Safari, Internet Explorer, etc.), the content of a cookie stored on the Terminal.

13.1 ecosystem is an eco-organisation approved by the public authorities. If its approval is withdrawn by the public authorities ecosystem shall be obliged to close its Site definitively.
13.2 ecosystem can also decide to close the Site for any other reason, and in particular if the REEECYC’LAB tool is unsuitable or obsolescent.
13.3 As far as possible, any closure shall be notified with sufficient notice to enable the User to make the necessary extractions on the terms stipulated in article 8 of the CGU. In event of urgency, ecosystem reserves the possibility of giving no notice.
13.4 Definitive closure of the Site shall lead to automatic and immediate cessation of the licence referred to in article 7 of the present CGU.
14.1. These GTU are governed by French law. Only the French-language version of the GTU has probative force between ESR and Users and can be used as evidence in court.
14.2. Any dispute relating to the use of the REEECYC'LAB tool and the application of the GTU shall be exclusively referred to the Commercial Court in Nanterre.
14.1 The present CGU are subject to French law. Only the version in French of the CGU shall have probative force between ecosystem and the User, and can be produced in law.
14.2 Any dispute relating to use of the REEECYC’LAB tool and application of the CGU shall come within the exclusive jurisdiction of Nanterre Commercial Court.
